1. Which personal data do we collect from you?
Personal data is all information about an identified or identifiable natural person that you provide to us or that is created or collected by us. With regard to our website, these are in particular:
Inquiry data: On our website we offer you different possibilities to contact us about inquirier. If you use the contact form provided for this purpose, data will be entered by you or collected about you in this context. This is especially the case in the following cases:
If you send us a general or specific inquiry via the contact form or e-mail addresses designated on our website, we will process the data provided therein to process your inquiry.
Data collection on our website
In the following, we explain what data we collect through our website, why we collect it and on what legal basis this is done. On our website we use server log files, several plug-ins and tools as well as various cookies required for their function.

Server log files
If you visit the website, information is automatically collected by the calling computer (hereinafter called "access data"). These access data includes server log files, which usually consist of information about the browser type and version, the operating system, the Internet service provider, the date and time of use of the website, the previously visited websites and the websites newly accessed and the IP address of the computer.
With the exception of the IP address, the server log files are not personal data. An IP address is only personal if the provider can identify the user by court order. Without such a court order, IP addresses are not personally identifiable by us.
Purpose and legal basis of the processing of server log files
When using this general data and information, we do not draw any conclusions about the person concerned. This information is rather used for a technically faultlesspresentation and optimization of our website - for this purpose the collection of server log files is essential. The processing is carried out in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our rightful interest in improving the stability and functionality of our website.

We are pleased that you are interested in our company and that you are applying or have applied for a job.
The protection of your data is very important to us. With the data protection notice we provide you with the following information on the processing of your personal data in connection with your application.
What data is processed in connection with your application and for what purposes?
We process the personal data provided to us in connection with your application in order to check your suitability for the position (or any comparable other vacancies/positions in our company) and to carry out the application procedure.
There is no automated decision making.
Without the provision of the data, the application procedure cannot be carried out and we are unfortunately unable to consider you when filling the respective position(s).
On which legal basis is the processing of your personal data based?
The legal basis for the processing of your personal data in the application procedure is Art. 6 para. 1 sentence 1 lit. b GDPR or in connection with Art. 88 para. 1 GDPR in connection with § Art. 26 para. 1 sentence 1 BDSG. If necessary, the processing is carried out with your consent in accordance with Art. 6 Para. 1 S. 1 lit. a GDPR (see below).
How long is the data stored?
Your application data will be processed for the duration of the application procedure and, in the event of a rejection, deleted after 6 months at the latest.
If you want us to add your data to our applicant Pool for the next possible vacancy, your applicant data will be deleted after 2 years at the latest. In this case, we require a corresponding consent,
which you can revoke at any time without giving reasons with effect for the future. The legality of the processing before the time of revocation remains unaffected.
If a hiring should occur during the application procedure, the data from the application system will be transferred to our personnel system.
in individual cases, a longer storage period may be required. The storage period then depends on the legal storage obligations such as the German Commercial Code or the German Fiscal Code.
To whom is the data passed on and where is it processed?
Your application documents will be evaluated upon receipt by employees of the human resources department or by and other responsible executives or specialists of our company. Within the company itself, only those persons who are responsible for the application process have access to your data.
Your data will be processed in the Career Portal of the SMS Group, which will use your data exclusively on our behalf and under no circumstances for its own business purposes. Please also take into account the data protection information in the Career - Portal when submitting your application.
Your data will not be processed in the third country and no such processing is planned.

2. For what purpose, on what legal basis and for how long do we process your personal data?

2.1 Your requests
If you send us inquiries via a contact form or e-mail, we will process the information you provide to answer your inquiry as well as the IP address and date/time of the inquiry to prevent misuse of the contact form.
The legal basis for the processing is our legitimate interest according to Art. 6 (1) lit. f GDPR to provide you with the requested service (e.g. contact request). If your inquiry is aimed at the initiation or processing (including customer service or warranty) of a contract, an additional legal basis for processing is Art. 6 (1) lit. b GDPR.
You may object to the processing of your data on the basis of Art. 6 (1) lit. f GDPR. We can then continue processing if we can prove compelling reasons for processing. In this case, this may be necessary in particular in order to provide evidence of past communications and inquiries with you. If there are no such compelling reasons, we will cease communication with you and delete data already collected.
This data will be deleted when our communication with you or the connection resulting from your inquiry with you is terminated, i.e. when the matter in question has been finally clarified and there are no further legitimate interests for storage or no further legal obligations for storage.


2.3 Advertising and product development (usage data, newsletter, etc.), right of objection
We would also like to use the data that you have already entered or accrued during your use of the websites to inform you about our products and services related to our product range ("services") (advertising) or to improve our offers and services (product development).


2.3.1 Anonymized usage data

The legal basis for processing is your consent (Art. 6 (1) lit. a GDPR) and our legitimate interests (Art. 6 (1) lit. f GDPR), if necessary in connection with § 7 (3) UWG.
This data will be deleted or only stored in aggregated, anonymous form after your objection or the revocation of any consents you may have given or otherwise at the latest after we have ceased using the data. If necessary, we will store the fact of your objection in order to prevent further contact with you.

3. Transfer of data

3.1 Transfer of data to contract processor
In some cases we use service providers in compliance with legal requirements by way of contract processing, i.e. on the basis of a contract on our behalf, according to our instructions and under our control.
Order processors are in particular technical service providers that we use to provide the website, e.g. service providers for software maintenance, computer center Operation and hosting or printing of materialsIn these cases, we remain responsible for data processing; the transfer and processing of personal data to or by our processors is based on the legal basis that allows us to process the data in each case. A separate legal basis is not required.

3.2 Transfer of data to third parties

3.2.1 Data transmission to other group companies of SMS group GmbH
If necessary, we will pass on your inquiry and the data you have provided to the relevant offices of the SMS group in Germany and other countries if this is necessary to answer your inquiry (e.g. because your inquiry relates to a business transaction or a price quotation from another country). The legal basis for the transmission is the provision of the service requested by you, Art. 6 (1) lit. b GDPR or our justified interest in processing your inquiry, Art. 6 (1) lit. f GDPR.
Please note that, depending on the nature of your request, this may involve the transfer of your personal data to countries outside the European Economic Area, which do not necessarily offer the same level of data protection. By signing EU standard contractual clauses (Art. 46 (2) GDPR), we ensure adequate protection of your data in these cases; a copy of the relevant contractual clauses can be obtained from the contact address mentioned in Section 7.

3.2.2 Plugins and Tools
This site uses the map service Google Maps via an API. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
To use the functions of Google Maps it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer.
The use of Google Maps is in the interest of an attractive presentation of our online offers and to make it easy to find the places we have indicated on the website. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f GDPR.

The responsible for the processing has integrated YouTube components on this website. YouTube is an Internet video portal that allows video publishers to post video clips free of charge and other users to view, rate and comment on them, also free of charge. YouTube allows the publication of all kinds of videos, which is why complete film and television programmes, but also music videos, trailers or videos made by users themselves can be accessed via the internet portal.

The operating company of YouTube is YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc, 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

Each time one of the individual pages of this website operated by the data processor on which a YouTube component (YouTube video) has been integrated, the internet browser on the data subject's information technology system is automatically prompted by the respective YouTube component to download a representation of the corresponding YouTube component from YouTube. Further information on YouTube can be found at www.youtube.com/yt/about/de/. Within the scope of this technical procedure, YouTube and Google receive information about which specific sub-page of our website is visited by the data subject.

If the person concerned is logged into YouTube at the same time, YouTube recognises which specific sub-page of our website the person concerned is visiting when a sub-page containing a YouTube video is called up. We carry out this processing exclusively on the basis of your previously given consent (see above under Cookies)
Google Analytics creates pseudonymous user profiles for us. The information generated by the Google Analytics cookie about your use of this website such as

With each individual call-up of our website that is equipped with a LinkedIn component (LinkedIn plug-in), this component causes the browser used by the data subject to download a corresponding representation of the component from LinkedIn. 6. Safety
We and our service providers take technical and organizational security precautions to protect your personal data managed by us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Every natural person whose personal data we process is basically (i.e. depending on the respective conditions) entitled to the following rights towards us:
If you have any questions about the processing of your personal data by us, we will be happy to provide you with information about the data stored about you free of charge (Art. 15 GDPR).
You have the right to have incorrect data corrected and incomplete data completed (Art. 16 GDPR).
You have the right to block/restrict the processing or deletion of your personal data that is no longer required or stored due to legal obligations (Ar.t 17, 18 GDPR).
You have the right to transfer the data in a structured, common and machine-readable format, provided that you have provided us with the data on the basis of a consent or on the basis of a contract between us and you (Art. 20 GDPR).
You have the right to object at any time to the processing of your data for direct marketing purposes (see also point 4, Art. 21 para. 2 and 3 GDPR)).
You have the right to object on the basis of a processing on the basis of a legitimate interest, whereby we can then present our compelling reasons (Art. 21 para. 1 GDPR). We have indicated above (see item 2) where this right exists.
If you have given your consent to data processing, you can revoke it at any time with effect for the future, i.e. the legality of the data processing up to the time of revocation remains unaffected. After you have revoked your consent, you may no longer be able to use our services.
